Terms of Service

These terms are an agreement between you and Orbitle Games (“Orbitle”, “we”, “us”) — the parent operator of the Orbitle family of services: orbitlegames.com (this site, its arcade, and your account hub), Orbitle Games AI (the game studio), Orbitle AI (asset generation) and the Orbitle game at playorbitle.com (together, the “Services”). By creating an account or using any Service you agree to these terms.
1 · Your account
One Orbitle account works across every Service. You must be at least 13 years old (or the minimum digital-consent age where you live). You are responsible for your account's security and for everything done with it. Keep your sign-in credentials and API keys secret — an Orbitle AI key can spend your credits.
2 · Gold (the one virtual currency)
Goldis the single currency across every Service — one balance that plays games, buys cosmetics, pays for AI game builds and asset generation (metered at compute cost plus a service margin, currently 25%), and funds creator reward pools. Gold is licensed to you, not owned: it has no cash value, can't be transferred or exchanged outside the Services, and — except where the law says otherwise or these terms say so (creator payouts, §5) — purchases are final and non-refundable. Prices may change; your existing balance is never reduced by a price change. Payments are processed by Stripe; we never see your full card details. (Legacy "credits" balances were converted to Gold at 1 credit = 2 Gold.)
3 · Publishing games (creator content)
Orbitle Games AI lets you build games and publish them to the arcade on orbitlegames.com. When you publish, you confirm that you accept these terms (we record that agreement), and you grant Orbitle a worldwide, non-exclusive, royalty-free licence to host, run, reproduce, promote and distribute your game within the Services — including in discovery placements chosen by our ranking systems. You keep ownership of your game. You can unpublish at any time; the licence ends for future distribution but survives for past promotion and backups for a reasonable period.
You are responsible for what you publish, including AI-generated content you direct. Content standards — published games must not contain:
- hate speech, slurs, or content targeting protected groups;
- sexual or pornographic content (the arcade is 13+);
- content sexualising minors in any form — instant, permanent ban;
- encouragement of self-harm, suicide, or eating disorders;
- glorification of real-world violence, terrorism, or cruelty;
- scams, phishing, malware, or attempts to break the sandbox;
- other people's IP or likeness without permission;
- gambling with real money or Gold wagering between players.
Cartoon/arcade violence is fine. We screen games automatically at publish time and may review, re-rate, suspend or remove any game at any time. Repeated or serious violations end your publishing rights and can end your account.
4 · Discovery & promotion
Arcade placement is decided by ranking systems that weigh engagement signals (plays, click-through, player retention, spending) together with editorial factors, randomised rotation so catalogues stay fresh, and occasional promotional windows for selected games (including newly published ones). Placement is never guaranteed and never sold.
5 · Creator earnings & payouts
- When players spend Gold inside your published game, you accrue earnings at the posted creator rate (currently US$3.50 per 1,000 Gold spent). The rate may change prospectively; accrued earnings keep the rate in force when they accrued.
- Payouts require a minimum of 2,000 Gold in claimable earnings and a payout account set up through Stripe Connect — Stripe collects your identity and bank details directly (we never see them) and pays into your bank on its payout schedule. Each request locks the account it was made with.
- Payouts are issued as Stripe transfers, normally at the time of request once funds have settled. We may hold, reject, or reverse earnings that come from fraud, self-dealing (spending in your own games is already excluded), bot traffic, or content-standard violations.
- You are responsible for any taxes on your earnings. Identity and tax information is collected by Stripe during onboarding where the law demands it.
- Instead of cashing out, you may claim earnings as spendable Gold (1:1, minimum 100 Gold) — to build with, play with, or fund reward poolsin your own games (milestones, competitions, prizes). Awards come out of your Gold balance, are capped per player per day, and stop automatically when your balance can't cover them. The same earned Gold can never be both claimed and paid out.
6 · Acceptable use
Don't: break, probe, or overload the Services; escape or attack the game sandbox; scrape at scale; buy or sell accounts, Gold, credits, or earnings; manipulate engagement signals (bot plays, click farms, impression spam); or use the Services to build a competing dataset. We may rate-limit, suspend, or terminate accounts that do.
7 · AI-generated content
Games and assets are generated by AI systems from your prompts. Output may resemble other people's output and may contain errors. To the extent permitted by law and subject to the licence in §3, we assign you our interest in the generated output of your builds. You publish it at your own responsibility, under §3's standards.
8 · Orbitle's property
The Services, their design, engines, SDKs, the Orbitle name, marks, logos, and official games are Orbitle's (or its licensors'). Apart from the rights these terms grant you, no rights are transferred.
9 · Termination
You can stop using the Services or delete your account at any time (contact us). We can suspend or terminate accounts that violate these terms, create risk for players, or as required by law. On termination, unspent virtual balances lapse except where law requires otherwise; legitimately accrued creator earnings above the minimum remain claimable for 90 days.
10 · Disclaimers & liability
The Services are provided “as is” — early access software changes fast and downtime happens. To the maximum extent permitted by law, we disclaim implied warranties, and our total liability for any claim is limited to the greater of US$50 or the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded (including under the Australian Consumer Law, where statutory guarantees may apply).
11 · Changes to these terms
We may update these terms as the Services evolve. Material changes are announced on the site with a new effective date; continuing to use the Services after that date accepts the change. Payout-affecting changes never apply retroactively to already-accrued earnings.
12 · Governing law & contact
These terms are governed by the laws of Victoria, Australia, and disputes belong to the courts there — without limiting any consumer rights you hold where you live. Questions, notices, IP complaints, account deletion: howtocook75@gmail.com.
